AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you and Bizzy AI, Inc. ("Company," "we," "us," or "our") governing your access to and use of the usebizzy.com website and any related services, including our AI-powered voice agent platform (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use our Services.

Bizzy AI provides AI-powered voice agent services designed to help businesses manage phone calls, appointments, and customer interactions. Our Services may include:
- AI voice agents for handling inbound and outbound calls
- Appointment scheduling and management
- Integration with third-party calendar and business tools
- Call transcription and analytics
- Custom voice agent configuration
The specific features available to you may depend on your subscription plan.
SMS/Text Messaging Communications
As part of our AI voice agent Services, we may send you SMS (text) messages to your mobile phone number. By using our Services and providing your phone number, you consent to receive text messages from us and our AI agents, including:
- Appointment confirmations and booking links
- Follow-up information related to your phone call with our AI agents
- Links to contracts, forms, or other documents discussed during calls
- Service notifications and transactional messages
Consent: By providing your phone number during a call with our AI agents or through our platform, you expressly consent to receive SMS messages. You may provide verbal consent during phone calls when an AI agent asks for your number to send relevant information.
Message Frequency: Message frequency varies based on your interactions with our Services.
Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier plan.
Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP to any message or by contacting us at support@usebizzy.com. After opting out, you will receive a confirmation message and will no longer receive SMS communications from us unless you re-consent.

2. ELIGIBILITY
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
If you are using our Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.
3. USER ACCOUNTS
To access certain features of our Services, you may need to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account

You retain ownership of any content you provide to us for use with the Services (such as business information, scripts, or voice samples). By providing such content, you grant us a license to use it solely for the purpose of providing the Services to you.
7. AI SERVICES AND THIRD-PARTY PROVIDERS
Our Services utilize artificial intelligence technologies, including services provided by third-party AI providers such as OpenAI. By using our Services, you acknowledge that:
- AI-generated responses may not always be accurate or appropriate
- You are responsible for reviewing and verifying any AI-generated content
- Your use of AI features is also subject to the terms and policies of our AI service providers
- We may share necessary data with AI providers to deliver the Services

8. PAYMENT AND BILLING
Certain features of our Services require payment. By subscribing to a paid plan, you agree to pay all applicable fees. Payment processing is handled by Stripe, and your use of payment services is subject to Stripe's Terms of Service.
Fees are subject to change. We will provide notice of any fee changes before they take effect.
9. TERMINATION
You may terminate your account at any time by contacting us at support@usebizzy.com.
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice.
Upon termination, your right to use the Services will cease immediately. Provisions of these Terms that by their nature should survive termination will survive.
10. DISCLAIMERS
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, error-free, or secure. AI-generated content may contain errors or inaccuracies.
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZZY AI, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Bizzy AI, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Services or violation of these Terms.
13. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
